Shipping policy

Effective Date: September 21, 2026

This Return, Refund & Shipping Policy (“Policy”) applies to purchases made through www.windathltx.com (the “Site”) and is incorporated into the Company’s Terms & Conditions. “Company,” “we,” “us,” and “our” mean WIND ATHLTX.

1. ORDER ACCEPTANCE

Submitting an order through the Site constitutes an offer to purchase the selected merchandise. An order acknowledgment or receipt does not constitute acceptance of the order. The Company reserves the right, in its sole and reasonable discretion and subject to applicable law, to accept, reject, limit, or cancel any order, including after an order confirmation has been issued, for reasons including:

  • pricing, promotional, typographical, or listing errors;

  • inventory or availability errors;

  • payment, billing, or shipping irregularities;

  • suspected fraud or unauthorized activity;

  • suspected reseller, bulk-purchasing, or commercial purchasing activity;

  • use of bots, automated purchasing systems, or other prohibited technology;

  • violation or suspected violation of the Terms & Conditions;

  • abuse or manipulation of promotions, discounts, referral programs, or return policies;

  • duplicate, excessive, or unusually large orders;

  • inaccurate or incomplete customer information; or

  • other circumstances reasonably indicating that fulfillment of the order would be inappropriate or contrary to Company policy.

If the Company cancels an order after payment has been submitted, the Company will refund amounts actually charged for the canceled merchandise, using the original payment method where reasonably practicable and as required by law.

2. PRICING ERRORS

The Company makes reasonable efforts to ensure that product descriptions, prices, promotions, and availability information are accurate. Nevertheless, errors may occur. If a product is listed at an incorrect price or with incorrect promotional terms, the Company may, to the extent permitted by law, cancel the affected order or portion of the order, even if the order has been confirmed or payment has been processed. If the Company cancels an order because of a pricing error, the Company will refund amounts actually charged for the canceled merchandise.

3. INVENTORY AND AVAILABILITY

Product availability is not guaranteed until the order has been accepted and processed for shipment. The Company may cancel or modify an order when inventory information is inaccurate, inventory becomes unavailable, merchandise is damaged, or an item cannot reasonably be fulfilled.

4. RESELLER AND COMMERCIAL PURCHASES

Unless expressly authorized in writing, purchases through the Site are intended for personal, non-commercial use. The Company may limit quantities, cancel orders, suspend accounts, or refuse transactions that reasonably appear to involve:

  • resale;

  • wholesale or commercial distribution;

  • unauthorized marketplace activity;

  • automated purchasing;

  • purchasing for third parties;

  • repeated use of multiple accounts to circumvent limits; or

  • circumvention or abuse of promotional restrictions.

5. CUSTOMER CANCELLATION

Customers may request cancellation before an order enters fulfillment by contacting info@windathltx.com. The Company will make reasonable efforts to honor cancellation requests but cannot guarantee cancellation after an order has entered fulfillment or shipment. Once an order has shipped, the customer must use the applicable return process.

6. STANDARD RETURNS

Unless otherwise stated for a particular product, eligible merchandise may be returned within 30 days after delivery. To qualify for a return, merchandise generally must be:

  • unworn and unused;

  • unwashed;

  • free from damage, stains, odors, alterations, or excessive wear;

  • accompanied by original tags and packaging where applicable; and

  • accompanied by valid proof of purchase.

The Company may reject a return that does not satisfy these requirements. Return eligibility and any refund determination are subject to the Company’s reasonable inspection of the merchandise and applicable law.

7. NON-RETURNABLE MERCHANDISE

Unless otherwise required by law, the following may be non-returnable:

  • final-sale merchandise;

  • personalized or customized merchandise;

  • gift cards;

  • digital products;

  • merchandise specifically identified as non-returnable;

  • promotional items; and

  • merchandise returned after the applicable return period.

8. RETURN AUTHORIZATION

The Company may require customers to obtain a return authorization before sending merchandise back. Customers should not send merchandise to an address other than the address provided by the Company for the applicable return. The Company may refuse unauthorized or improperly addressed returns.

9. RETURN SHIPPING COSTS

Unless the Company shipped the wrong item, the merchandise was defective or damaged upon arrival, or applicable law requires otherwise, the customer is responsible for return shipping costs. Original shipping charges generally are nonrefundable except where required by law or where the Company determines that the return resulted from Company error.

10. REFUNDS

Once an eligible return is received and inspected, the Company will determine whether the merchandise qualifies for a refund. Approved refunds will generally be issued to the original payment method. Refund processing times may vary based on the customer’s bank, card issuer, payment provider, or other financial institution. The Company is not responsible for delays attributable to third-party payment processors after the Company has initiated the refund.

Where applicable law requires a refund within a particular period or in a particular form, that requirement controls.

11. DEFECTIVE OR DAMAGED MERCHANDISE

Customers should contact Customer Service promptly regarding merchandise that arrives damaged, defective, or materially different from what was ordered. The Company may request photographs, packaging information, order information, or other reasonable documentation before issuing a replacement, refund, or other remedy. Nothing in this Policy limits any non-waivable statutory warranty or consumer right.

12. SHIPPING

Shipping estimates are estimates and are not guaranteed delivery dates unless expressly identified as guaranteed. The Company may use third-party carriers and is not responsible for delays caused by weather, carrier interruptions, customs, governmental actions, natural disasters, labor disruptions, inaccurate customer information, or other circumstances outside the Company’s reasonable control. The customer is responsible for providing a complete and accurate shipping address.

13. LOST, STOLEN, OR MISDELIVERED PACKAGES

Once a carrier confirms delivery to the address provided by the customer, the Company is not responsible for theft or loss occurring after delivery, except where otherwise required by law. Customers should promptly contact the carrier regarding packages shown as delivered but not received. The Company may, in its discretion, investigate delivery claims and may request documentation or other information before providing any replacement or refund.

14. INTERNATIONAL ORDERS

International customers may be responsible for customs duties, taxes, brokerage charges, import fees, and other governmental assessments. Unless expressly stated otherwise, such charges are the customer’s responsibility. International returns may be subject to additional restrictions, costs, and customs requirements.

15. PROMOTIONAL PURCHASES

Special promotions may have separate return, refund, eligibility, quantity, or expiration requirements. If a promotion includes specific terms, those terms control to the extent they conflict with this Policy.

16. GIFT CARDS

Gift cards are subject to applicable law concerning expiration, fees, refunds, replacement, escheatment, and other requirements. Except where required by law, gift cards are not redeemable for cash and are not returnable.

17. FRAUD, ABUSE, AND RETURN-POLICY MANIPULATION

The Company may investigate transactions and return activity that reasonably appears fraudulent, abusive, deceptive, or designed to circumvent Company policies. Subject to applicable law, the Company may restrict return privileges, suspend or terminate accounts, cancel orders, decline transactions, or take other lawful action where there is reasonable evidence of abuse or fraud.

Examples may include repeated excessive returns, materially inaccurate return claims, fraudulent chargebacks, use of multiple accounts to evade restrictions, or coordinated abuse of promotions.

18. PAYMENT DISPUTES AND CHARGEBACKS

Customers should contact Customer Service before initiating a payment dispute when the issue can reasonably be resolved directly. The Company reserves all rights with respect to unauthorized, fraudulent, duplicative, or otherwise improper chargebacks and payment disputes. Where a chargeback is initiated, the Company may provide the payment processor, card network, bank, or other authorized party with transaction records, shipping records, communications, and other information reasonably necessary to respond to the dispute. Nothing in this section restricts any lawful right a consumer may have to dispute an unauthorized or improper charge.

19. SHIPPING DELAYS

If the Company becomes unable to ship merchandise within an applicable promised timeframe, the Company will provide any notice, revised shipping option, cancellation option, and refund required by applicable law. Nothing in this Policy permits the Company to waive or contract around non-waivable consumer protections.

20. POLICY MODIFICATIONS

The Company may modify this Policy from time to time. The version applicable to an order is generally the version in effect when the order was placed, except where applicable law requires otherwise.
