4.1 Required DMCA Notice

A DMCA notice should contain substantially the following:

  1. identification of the copyrighted work claimed to have been infringed;

  2. identification of the allegedly infringing material and information reasonably sufficient to locate it;

  3. contact information for the complaining party;

  4. a statement that the complaining party has a good-faith belief that the disputed use is unauthorized;

  5. a statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner; and

  6. the physical or electronic signature of the copyright owner or authorized representative.

4.2 Counter-Notification

If material is removed or disabled in response to a DMCA notice, the affected user may submit a counter-notification where permitted by the DMCA.

A valid counter-notification should identify the removed material, state the user's good-faith belief that the material was removed as a result of mistake or misidentification, provide required contact information, and contain the legally required statements and signature.

Company may restore material where legally required or appropriate.

5. Repeat Infringers

Company may terminate accounts or restrict access of users who repeatedly infringe intellectual-property rights.

6. Accessibility

Company seeks to make the Site accessible to users with disabilities and endeavors to conform to WCAG 2.1 Level AA.

Accessibility concerns may be reported to: info@windathltx.com

7. Advertising and Influencer Disclosure

Company requires paid influencers, affiliates, ambassadors, employees, contractors, and other compensated endorsers to clearly disclose material connections with Company.

A material connection may include:

  • payment;

  • free products;

  • discounted products;

  • commissions;

  • affiliate compensation;

  • employment;

  • family relationships; or

  • other material benefits.

Disclosures should be clear, conspicuous, and placed with the endorsement.

For example:

#Ad
#Sponsored
Paid partnership with WIND ATHLTX

Company does not permit influencers to represent that they independently purchased or reviewed a product when they received compensation or other material consideration without appropriate disclosure.

The FTC specifically recognizes that free or discounted products can constitute a material connection requiring disclosure and advises that disclosures should be difficult to miss and understandable to ordinary consumers.

8. Consumer Reviews

Reviews must represent the reviewer's honest opinions and actual experiences.

Company prohibits:

  • fabricated reviews;

  • fake reviews;

  • reviews by people who have not used the product;

  • undisclosed paid reviews;

  • manipulation intended to create a misleading impression;

  • review suppression based solely on unfavorable content; and

  • materially misleading testimonials.

The FTC's current endorsement guidance specifically addresses incentivized reviews, fake reviews, review manipulation, and material connections.

9. Social-Media Sharing

Users may share Company content through legitimate social-media functionality, subject to the applicable platform's rules and these Terms.

Users may not imply that they are Company representatives, employees, sponsors, or authorized partners unless they actually are.
