SMS TERMS & CONDITIONS

These SMS Terms & Conditions (“SMS Terms”) govern participation in SMS/MMS messaging programs operated by WIND ATHLTX (“Company,” “we,” “us,” or “our”). By providing a telephone number and affirmatively consenting to receive marketing text messages, you agree to these SMS Terms and the Company’s Privacy Policy.

1. PROGRAM DESCRIPTION

The Company may use SMS/MMS messages to provide:

  • promotional offers;

  • product announcements;

  • sales and discounts;

  • cart or browsing reminders where appropriately consented;

  • account-related communications;

  • order information;

  • customer-service communications; and

  • other messages permitted by applicable law and the consent provided.

2. EXPRESS CONSENT

Where required by law, the Company will obtain appropriate consent before sending promotional SMS/MMS messages. Your consent is not a condition of purchasing goods or services from the Company. You represent that the telephone number provided by you is your own number or that you are authorized to provide it and receive messages at that number.

Message frequency may vary depending on your interaction with the Company and the applicable messaging program.

4. MESSAGE AND DATA RATES

Message and data rates may apply depending on your mobile carrier and plan. The Company does not control carrier charges.

5. HOW TO OPT OUT

You may opt out of promotional SMS messages at any time by replying: STOP

You may receive a final confirmation message confirming your opt-out. After opting out, you will no longer receive promotional messages from that program unless you provide a new consent.

7. CARRIER LIABILITY

The Company and participating carriers are not responsible for delayed or undelivered messages.

8. CHANGES TO TELEPHONE NUMBERS

You agree to promptly notify the Company if you cease using a telephone number associated with your SMS consent.

The Company may rely on the information provided by you unless and until updated.

9. CONSENT RECORDS

The Company may maintain records of consent, opt-outs, telephone numbers, timestamps, source pages, and related information for compliance, operational, security, and dispute-resolution purposes.

10. TRANSACTIONAL MESSAGES

Opting out of promotional messages does not necessarily prevent the Company from sending non-promotional communications that are necessary to complete transactions, provide requested services, secure an account, respond to a customer inquiry, or satisfy legal obligations.

11. PRIVACY

Information collected in connection with SMS communications is handled in accordance with the Company’s Privacy Policy.

12. REVOCATION AND RECONSENT

If you opt out and later wish to receive promotional SMS messages again, you may re-enroll through an authorized Company enrollment mechanism.

13. GOVERNING TERMS

These SMS Terms supplement the Company’s Terms & Conditions. To the extent of a conflict, applicable law controls.

The Company may modify the SMS program, including its content, frequency, or participating carriers, subject to applicable law.
