The DMCA requires qualifying service providers seeking the statutory safe harbor to designate an agent and maintain current agent information with the Copyright Office. 

Required DMCA Notice

A DMCA notice should contain substantially the following:

  1. identification of the copyrighted work claimed to have been infringed; 

  2. identification of the allegedly infringing material and information reasonably sufficient to locate it; 

  3. contact information for the complaining party; 

  4. a statement that the complaining party has a good-faith belief that the disputed use is unauthorized; 

  5. a statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner; and 

  6. the physical or electronic signature of the copyright owner or authorized representative. 

Counter-Notification

If material is removed or disabled in response to a DMCA notice, the affected user may submit a counter-notification where permitted by the DMCA.

A valid counter-notification should identify the removed material, state the user's good-faith belief that the material was removed because of mistake or misidentification, provide required contact information, and contain the legally required statements and signature.

Company may restore material where legally required or appropriate.

Repeat Infringers

Company may terminate accounts or restrict access of users who repeatedly infringe intellectual-property rights.
